I received more calls today from newsagents dealing with banks which refuse to act on their instructions to cancel direct debit arrangements for Bill Express equipment. ANZ and Westpac are the banks letting newsagents down based on today’s calls. In each case, newsagents had put their direct debit cancellation in writing and in each case their respective banks had refused to act. Thankfully, one the Westpac branch relented after the newsagent went in with information about the Code of Banking Practice.
The behaviour of banks is appalling on this matter of the Bill Express equipment. The ASIC website is clear on bank obligations as is the website for the banking Industry Ombudsman. It is as if staff in local bank branches have not heard about their obligations. Newsagents are having to go back two and three times before getting reasonable attention.
Time is an issue here since the next round of debits are to be made less than a week from now.

You wanted to know how I went with lodging a Customer Claim Form with the Commonwealth Bank to see if we could get back the B/Exp lease payments drawn by CHP Lease Repayments (Perpetual Nominees) in April and May. We lodged the form last week (6 Aug) on the basis that we had not signed an authorisation with that organisation to do drawings on our account. I’ve just checked my account on the internet and there is a credit coming through for $1089 (2 x $544.50)…..I’m excited!!!!

is it the money that we put a stop to or is the money that was coming out after bill express stopped giving us the rental back ?i am a bit confused to what money we are talking about

I spoke to my bank, the NAB, they advised that the proper authority was held to debit my account and that there was nothing that they could do to help me. I lodged an online complaint with the banking ombudsman last week. Today I received an email from the bank stating that they are refunding three payments into my account today. As a gesture of goodwill they also offered and have paid $100.00 to compensate for the hassle of having to take the matter to the banking ombudsman….. I am thrilled!

The April & May payments I got back were the ones drawn after B/Exp stopped giving us the full rebate, which also co-incided with the change of organisation who drew these payments from our account. Our direct debit agreement was with Mobius…but the last two payts were drawn by Perpetual Nominees….we never signed a new direct debit authority to agree to Perpetual Nominees drawing funds – on this basis we got the refund from our bank. We suspended the Mobius direct debit authority in the middle of June (under legal advice from Hank Spier who is acting for the class action of which we are part of). No further drawings have been taken from our account. We have also taken the precaution of opening a new account and closing the old account just to be on the safe side.

Liz yeah we stopped ours in july and so far it has not been touched since that date . so it is for the two months prior that is what we can try and get back

Liz – any chance of letting us know what branch of the Commonwealth you dealt with – my branch has stopped the direct debits for me but claims they don’t know what to do in terms of refunding the CHP debits in April & May and would like to talk to a branch which has done it to see how they went about it.
