Bill Express creditors meeting

The documents include details of the creditors meeting to be held at 1pm tomorrow in Melbourne at the Marriott Hotel. Click here for a smaller file containing the proof of debt and proxy forms. I will be attending the meeting with our Financial Controller.

Newsagents are creditors of Bill Express because the company has withhed 20% of our previously agreed Bill Payment revenue to be spent on a marketing campaign which never materialised. They also withheld 10% of our revenue for administration costs which I would consider is an amount we could dispute. To calculate the amount Bill express owes you calculate the number of bills paid between February and when Bill Express died and multiply this by 20 cents.

    ANF has sent us a proxy to fill in nominating them as our proxy. I am a little dubious about giving them the proxy.
    There are a number of different companies to claim against and ANF has only mentioned Bill Express.
    Should’nt we have claimed POD tv as well as an example.

    David, I’d suggest you not appoint the ANF as a proxy. Not for any legal reason but because they got you into this.

    yeah, we’ve just got the fax and email from ANF.

    I’ll certainly not be sending them a return copy to represent us.

    however should other state newsagents need to put in a claim for themselves, then how do we go about it?

    Does it matter how little the amount is – our small newsagency was only doing approx 55 bill payts per month, multiplied by .20cents, this amounts to about $55. Are we able to claim the advertising and phonecard sales rebates which BE stopped paying us earlier this year?

    Yes, I also had a bit of a chuckle at the ANF fax -they nearly missed the whole thing by that much yet again!

    Here in Qld, QNF have advised us to sent any proxy forms to you to take to the creditors’ meeting tomorrow on our behalf. Thanks for attending.

    As our small agency major use was phone recharge, and the commission has been paid, am I able to claim to be creditor for the loss in the advertising rebate for the last 5 months?

    I’m interested to know if the ANF will only accept the proxy if you’re a member.

    if not then why fax everybody? i got one and have never been a member.
