Cancelling the Bill Express equipment lease

The ANF has changed its advice on the Bill Express direct debit but its recommendation remains unclear. NANA and the QNF are having no such difficulty in providing advice to their members. The level advice from the QC who has prepared the Class Action is that newsagents should not continue to pay for the lease of the equipment, advice that newsagents cancel the direct debit. Newsagents ought to get their own advice on this, I provide information here as to the advice provided to QNF and NANA members for information only.

It has been suggested from people who would know something of the sale of the Technology Business International debtors to Mobius, part of Allco, that great care was taken on the appropriate structuring of the transaction. I guess this is part of what will ultimately be tested in court.

    I thought the contracts for the equipment was sold off to another company meaning that if they went under you may still have to pay the rental

    The week prior to the fall out of BX I requested these details for the the rep Andrew Monte form BX. I was told be the Sales rep for BX that the agreement for the rental was between myself and Mobius and that I would have to contact them myself, he then added- you will find the Mobius listing in the white pages. I have all telephone books for all capital cities and the major Areas in my store and guess what, the only Mobius listed was a private house in SA. I was then told by BX that they could not give out the contacts because of the privacy agreement. Anybody else experienced this?

    The bank told me that since I do not know who to contact to cancel the DD for Bill Express, then the only option left is to close the account and open another one. What are the repercussions, if any?

    If this is the poor advice being given to you by your bank then I would consider banking somewhere else.

    They are able to block another account from direct debiting your own. They are able to get the accont details they need to block from previous direct debits made by Bill Express.

    Jarred is correct – I’m ex-CBA staff and all our accounts are with CBA. Our BExp and related parties Direct Debits have been successfully stopped and we continue to use our existing accounts. Just monitor your account closely and if anything that appears to be unauthorised is debited get the bank to immediately reverse it – it can be done – go further up the bank management line if you are having problems with the bank staff you are dealing with.
